Ostra Fyducia™ is a service of Jet Fyul Dynamics LLC ("we," "us," "our"). Ostra Fyducia is a registered service mark, USPTO Reg. No. 8009699. In these Terms, "you" means the person who purchases or uses the service.
This service is self-help software. It prepares trust documents from the answers you provide, using templates built on the statutes of the state you select. You are the author of your documents; the software assembles them from your input.
We are not a law firm. We are not your lawyer. We do not provide legal advice. No part of this service — not the questions, not the explanations, not the documents it produces — is legal advice, and using it does not create an attorney-client relationship. The explanations offered during the intake are general information to help you make your own choices; they are not advice about your specific situation.
We do not review your documents for your particular circumstances, and we do not tell you whether a trust is the right choice for you, which options you should select, or whether your plan accomplishes your goals. Those are legal judgments. If you want advice about your specific situation, consult a licensed attorney in your state. For many people — those with larger or taxable estates, blended families, a beneficiary with special needs, property in more than one state, or complex business holdings — an attorney's involvement is strongly advisable, and nothing here should discourage it.
Upon completing the intake and any required steps, you receive a set of documents prepared from your answers: a trust instrument and, where applicable, the instruments to transfer your company interests into the trust, a certification of trust, and an execution checklist. The documents are not signed, executed, or legally effective when you receive them. They become effective only when you complete the steps on your execution checklist — reading them, signing them properly, notarizing where required, obtaining any consents your operating agreements require, and transferring (funding) property into the trust. A trust that is never funded does not do what a trust is meant to do.
What this package does not include. This package prepares your trust and its funding documents. It does not currently include a pour-over will, a power of attorney, or a healthcare directive. It does not include attorney review. It does not file anything with any court or government office, and it does not retitle your property for you.
You are responsible for the accuracy and completeness of the answers you give. The documents can only be as correct as your input. You are responsible for reading every document before you sign it, for signing and funding the trust properly, and for deciding whether the plan you have chosen fits your needs. You confirm that you are at least 18 years old and are preparing documents for yourself (or for someone you are lawfully authorized to act for).
This service currently prepares trusts under the law of the states listed as available at the time of your purchase. If your state is not available, the intake will tell you, and you may join the waitlist. We add states over time; we do not promise any particular state by any particular date.
The price is shown before you purchase. Payment is processed by Stripe; we do not receive or store your full card or Cash App account details. You agree to the price displayed at checkout for the payment method you choose.
Because your access is delivered immediately upon purchase and the documents are generated from your answers, all sales are final once your access code has been issued, except where a refund is required by law. If you were charged in error, were unable to access the service, or believe there has been a mistake, contact us at contact@ostrafyducia.com and we will work with you in good faith to make it right.
Our handling of your information is described in our Privacy Policy. In short: we never collect Social Security or tax identification numbers online; your intake answers are used only to prepare your documents; and we do not sell your information.
The service, its software, its templates, and the Ostra Fyducia name and marks are ours. The documents produced from your answers are yours to use for your own purposes. You may not copy, resell, or redistribute the service itself, its templates, or its underlying materials.
The service is provided "as is." We work hard to build documents that rest on current statutes and hold up when used correctly, and we tell you honestly what the service does and does not do. But we do not warrant that the documents will achieve any particular legal or tax result for you, because that depends on facts we do not evaluate, on steps you must complete yourself, and on law that can change. We do not guarantee the service will be uninterrupted or error-free. This section does not exclude anything that cannot lawfully be excluded.
To the fullest extent permitted by law, our total liability to you for any claim arising out of the service is limited to the amount you paid us for it. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to hold us harmless from claims arising out of your own misuse of the service or your violation of these Terms.
We may update these Terms. The version in effect when you purchase governs your purchase. Continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules.
